1. Parties and Acceptance of Terms
These terms of service (hereinafter referred to as "terms") constitute a legally binding agreement between Semust (hereinafter referred to as "service provider") and the user accepting the agreement (hereinafter referred to as "customer"). By creating an account, subscribing to the services, or using the Semust platform, the customer acknowledges that they have read, understood, and agree to be bound by these Terms.
2. Subject of the Agreement
This agreement covers the terms and conditions under which the service provider grants the customer access to the Semust online software platform (hereinafter referred to as the "service").
3. Terms of Service
3.1 The service includes, but is not limited to, tools for keyword research, rank tracking, SERP analysis, on-site SEO audits, content generation, and other related features as offered on the website.
3.2 The service is offered through online access using a continuously updated database.
4. Fees and Payment Terms
4.1 Fees and payment terms are determined by the customer's selected subscription plan and are clearly displayed on the Semust platform.
4.2 Payments are made by the customer using the chosen payment method in accordance with the plan.
5. Duration and Termination
5.1 This agreement becomes effective when the customer activates a subscription and remains valid for the subscription period.
5.2 Either party may renew or terminate the agreement at the end of the subscription period.
6. Privacy and Data Protection
6.1 The service provider is committed to keeping the confidentiality of customer data.
6.2 The customer is responsible for maintaining the confidentiality of any data they access or process through the service.
7. Limitation of Liability
7.1 The service provider does not guarantee uninterrupted or error-free access and is not liable for damages arising from technical malfunctions or access problems.
7.2 The service provider is not liable for indirect damages that may arise from the use of the service.
8. Dispute Resolution
8.1 Any dispute arising between the parties will primarily be attempted to be resolved through bona fide negotiations.
8.2 If no agreement is reached, the applicable law and competent court provisions shall apply.
9. Entire Agreement
This agreement reflects the full understanding between the parties and overrides any prior agreements or communications.
